1. Nature of the Platform

The Company operates as an online technology-enabled marketplace and facilitation platform that enables Customers, Dealers, Buyers, Sellers, Financial Institutions, Insurance Companies, Warranty Providers, Evaluators, Auction Participants, RTO Consultants, and other independent third-party service providers to connect with one another through the Platform for various automobile-related services and transactions.

The Platform is intended to provide one-stop accessibility, digital convenience, communication support, listing services, inquiry forwarding services, and marketplace facilitation for automobile-related requirements across multiple jurisdictions globally.

2. Information Collected

The Company may collect personal, business, transactional, technical, and vehicle-related information from Users including but not limited to full name, mobile number, email address, residential or business address, vehicle registration details, ownership documents, government identification details, dealership credentials, GST information, financial details, payment records, uploaded documents, photographs, inspection reports, communications, browsing data, IP address, cookies, device details, analytics information, and any other information voluntarily submitted by the User while accessing or using the Platform.

The Company may also automatically collect certain technical and analytical data for operational, security, monitoring, fraud prevention, and service improvement purposes.

3. Purpose of Collection and Use of Information

The information collected by the Company may be used for account creation, user verification, vehicle listing services, facilitating vehicle purchase and sale, enabling evaluations and auction participation, inquiry forwarding, communication with dealers or service providers, customer support, fraud prevention, regulatory compliance, analytics, marketing, promotional activities, platform improvement, operational management, and other legitimate business purposes connected with the functioning of the Platform.

The User expressly consents to the use of such information for the aforesaid purposes.

4. Third-Party Service Facilitation

The User expressly understands and acknowledges that the Company merely acts as an intermediary platform and facilitation mechanism for connecting Users with independent third-party service providers including but not limited to dealers, buyers, sellers, financiers, insurers, warranty providers, evaluators, auction participants, consultants, garages, service centers, and RTO-related entities.

The Company may provide contact details, inquiry forwarding, digital communication access, listing facilities, marketplace visibility, lead generation support, and related facilitation services for better connectivity and convenience of Users.

However, the Company itself does not directly provide insurance services, loan approvals, financial services, warranty commitments, RTO approvals, ownership transfer guarantees, inspection certifications, legal verifications, or vehicle quality assurances unless specifically agreed under a separate written agreement.

5. Disclaimer of Liability

The User expressly agrees that any services, transactions, negotiations, arrangements, or dealings undertaken with any third-party dealer, buyer, seller, insurer, financier, evaluator, auctioneer, warranty provider, consultant, or any other service provider shall be solely at the User's own discretion, responsibility, and risk.

The Company shall not be responsible or liable in any manner whatsoever for the acts, omissions, negligence, fraud, misconduct, deficiency, delay, rejection, cancellation, dispute, misrepresentation, breach, quality, legality, safety, delivery, or performance of any third-party service or transaction facilitated through the Platform.

The Company shall further not be liable for any direct, indirect, incidental, consequential, special, commercial, reputational, financial, or punitive damages arising from or relating to vehicle transactions, fraudulent listings, incorrect information, title disputes, loan rejection, insurance claim disputes, warranty disputes, evaluation discrepancies, auction disputes, hidden defects, ownership issues, document discrepancies, RTO-related complications, payment disputes, third-party misconduct, offline dealings, service failures, delays, or any losses suffered by the User arising from services availed through the Platform.

The Company merely provides contact accessibility and online facilitation at one place for User convenience and shall not assume any direct or indirect liability arising from services availed by Users from independent third parties.

6. User Responsibility and Due Diligence

The User expressly agrees and acknowledges that the Company does not verify or guarantee the authenticity, ownership, condition, valuation, legality, documentation, roadworthiness, financial standing, or credentials of any vehicle, dealer, buyer, seller, or third-party service provider available on or connected through the Platform.

Users are solely responsible for conducting independent verification, due diligence, inspections, legal checks, documentation review, ownership validation, payment verification, and financial assessment before entering into any transaction or arrangement.

7. Sharing and Disclosure of Information

The Company may share User information with relevant third-party service providers, dealers, insurers, financiers, evaluators, auction partners, warranty providers, technology vendors, payment gateways, analytics providers, legal authorities, consultants, or government agencies wherever necessary for operational, legal, compliance, facilitation, security, or business purposes.

By using the Platform, the User expressly consents to such sharing and disclosure of information.

8. Communication Consent

The User expressly authorizes the Company and its associated third-party service providers to contact the User through telephone calls, SMS, WhatsApp, email, push notifications, or other electronic communication methods regarding inquiries, promotions, services, verifications, support, updates, reminders, or business communications connected with the Platform.

9. International Operations and Data Transfer

As the Company may expand and operate globally, User information may be processed, transferred, stored, or accessed outside India subject to applicable legal requirements and reasonable security safeguards.

By using the Platform, the User expressly consents to such international transfer, storage, and processing of information.

10. Data Security

The Company undertakes commercially reasonable security measures, technical safeguards, and operational procedures to protect User information against unauthorized access, misuse, alteration, disclosure, or destruction.

However, no electronic platform, server, or internet-based transmission can be guaranteed to be completely secure, and therefore the Company does not guarantee absolute security of information.

11. Cookies, User Consent, and Tracking Technologies

The Platform operated by Luxurya Cars Private Limited – Caryanams may use cookies, analytical tools, tracking technologies, session identifiers, and similar digital mechanisms for improving user experience, understanding usage patterns, monitoring performance, maintaining platform security, personalizing services, enabling login authentication, and enhancing operational efficiency.

While registering, signing up, or logging into the Platform, whether through the mobile application or website, the User shall be required to provide consent to the Company's Terms & Conditions, Privacy Policy, and Cookie Policy through a pop-up, checkbox, click-wrap mechanism, or any other electronic consent system prior to proceeding further on the Platform.

By continuing to access or use the Platform, the User expressly acknowledges, confirms, and agrees that they have read, understood, and accepted all such policies, terms, conditions, disclaimers, and notices made available by the Company from time to time.

Continued access or use of the Platform shall constitute the User's ongoing consent to the use of such cookies, tracking technologies, and related operational mechanisms implemented by the Company.

12. Protection of Important Documents, Reports, and Digital Records

The Company may generate, issue, store, display, process, or provide access to certain important documents, screenshots, reports, inspection reports, booking confirmations, invoices, QR codes, transaction details, tickets, digital records, communications, certificates, or similar materials through the Platform. All such records, documents, and reports shall remain confidential, proprietary, and protected information of the Company and/or the concerned User.

The User shall not misuse, tamper with, manipulate, unlawfully transfer, duplicate, circulate, reproduce, publish, download for unauthorized purposes, or permit any unauthorized access, sharing, or transmission of such records from one person to another without lawful authorization or prior written consent of the Company.

The Company reserves the absolute right to implement technical restrictions, monitoring systems, encryption measures, watermark protections, access limitations, and other security mechanisms for preventing unauthorized access, copying, extraction, disclosure, misuse, or transfer of such confidential documents, reports, and records available on or generated through the Platform.

Any misuse, unauthorized circulation, tampering, duplication, fraudulent use, or unlawful disclosure of such records may result in suspension or termination of access to the Platform and may further attract civil and/or criminal liability under applicable laws.

13. Prohibited Activities

Users shall not upload, post, transmit, publish, or share any false, misleading, fraudulent, defamatory, infringing, illegal, unauthorized, or deceptive information, vehicle listings, documents, or content through the Platform.

The Company reserves the right to suspend, restrict, terminate, or remove any User account, listing, or content violating applicable laws, third-party rights, or Company policies.

14. Intellectual Property Rights

All content, software, technology, databases, trademarks, branding materials, graphics, text, logos, designs, and intellectual property associated with the Platform shall remain the exclusive property of the Company unless otherwise stated and shall be protected under applicable intellectual property laws.

No User shall copy, reproduce, distribute, modify, or commercially exploit any Company intellectual property without prior written authorization.

15. Limitation of Liability

To the maximum extent permitted under applicable law, the aggregate liability of the Company arising out of or relating to the use of the Platform shall be limited solely to the amount actually paid by the User, if any, to the Company for accessing the Platform services.

16. Indemnification

The User agrees to indemnify, defend, and hold harmless the Company, its directors, employees, affiliates, representatives, agents, and partners from and against any claims, liabilities, damages, losses, penalties, costs, legal proceedings, or expenses arising out of or related to User misconduct, breach of this Policy, violation of applicable laws, third-party disputes, fraudulent activities, misuse of the Platform, or infringement of rights.

17. Governing Law and Jurisdiction

This Privacy Policy shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to this Privacy Policy or use of the Platform shall be subject to the exclusive jurisdiction of the competent courts situated at Ahmedabad, Gujarat, India.

18. Modification of Policy

The Company reserves the right to amend, revise, update, or modify this Privacy Policy at any time without prior notice.

Continued access or use of the Platform after such modification shall constitute acceptance of the revised Policy.
